Terms of Service

By using Pathshala by MJX (the "Service"), you agree to these Terms. Please read carefully.
1. Service Description
Pathshala by MJX is a multi-tenant SaaS school management platform with AI-powered WhatsApp automation. The Service is provided by MJX Technologies LLP, a Startup India registered Indian company.
2. Account Eligibility
You must be at least 18 years old and authorized to bind your school to a commercial agreement. Schools must be legitimately operating educational institutions in India.
3. Subscription and Billing
- Monthly billing in advance, in Indian Rupees (INR)
- 18% GST extra, as per Indian tax law
- No setup fees, no long-term contracts
- Cancel anytime — data accessible for 30 days post-cancellation
- Payment via UPI, bank transfer, or online payment gateway
4. Acceptable Use
You will NOT:
- Use the Service for illegal, harassing, or fraudulent activities
- Send unsolicited spam via WhatsApp (violates Meta policy AND our policy)
- Upload illegal content, malware, or copyrighted material without permission
- Attempt to reverse-engineer or breach the Service
- Resell or sublicense without our written permission
- Use the Service to compete directly with MJX Technologies
5. WhatsApp Business API Compliance
When using our WhatsApp integration:
- You must comply with Meta's WhatsApp Business Policy
- No spam, marketing without consent, or misleading content
- Respect parent opt-outs and unsubscribe requests
- Use template messages only for legitimate transactional purposes
- Meta may suspend your access for violations
6. AI and Automation
Our AI uses your school's knowledge base to generate auto-replies. While we strive for accuracy, AI responses are not guaranteed to be 100% accurate. You are responsible for reviewing AI-generated content and configuring the knowledge base. We recommend the owner manual reply override for critical conversations.
7. Data Ownership
Your school's data (inquiries, conversations, uploaded documents) belongs to you. We process it on your behalf. You can export or delete your data anytime. See our Privacy Policy for details.
8. Intellectual Property
The Pathshala platform, software, and branding are owned by MJX Technologies LLP. You receive a non-exclusive, non-transferable license to use the Service during your active subscription. Source code is proprietary.
9. Service Availability
We aim for 99.5% uptime but make no SLA guarantees on Starter plans. Pro and Complete plans include SLA commitments. Scheduled maintenance will be notified 24 hours in advance.
10. Limitation of Liability
To the maximum extent permitted by Indian law, our total liability for any claim is limited to the amount you paid us in the previous 3 months. We are not liable for: indirect damages, lost profits, data loss caused by your actions, third-party service failures (Meta, Anthropic, etc.), or force majeure events.
11. Termination
You may cancel anytime from the dashboard. We may terminate your account for: non-payment, terms violation, abuse of Service, or legal requirement. Upon termination, data is retained 30 days for recovery, then permanently deleted.
12. Governing Law
These Terms are governed by the laws of India. Jurisdiction: courts in Madhya Pradesh, India.
13. Changes to Terms
We may update these Terms. Material changes notified via email and portal banner. Continued use after changes = acceptance.
